This Briefing comes in response to the increasing number and complexity of requests NHS Confederation members are receiving under the Freedom of Information Act.

It is intended to be used as a practical guide to help NHS organisations fulfil the spirit of the legislation in the most timely and efficient way.

Review of LIFT (Local Improvement Finance Trust) carried out by Caroline Rassell, finance director of North East Essex PCT (9th December 2008)
Following a Freedom of Information (FOI) request for a copy of the review, the Department of Health replied that it expected the review to be available by the end of November. The review is now available.

Practical Guidance: Destruction of requested information (October 2008)
The Information Commissioner has published guidance reminding public authorities when information that is or may be subject to a request for disclosure under the Freedom of Information Act, can be destroyed. For example, it is permissible to destroy information in accordance with a data retention policy, but not good practice to do if a freedom of information has been submitted.

Model Publication Scheme 2009 (October 2008)

The Information Commissioner has published a new model publication scheme for public authorities (central and local government, health, education etc) subject to the Freedom of Information Act and which relevant bodies will be encouraged to adopt from 1 January 2009. Enforcement measures will be supplemented by spot checks from February 2009.
