LEARNING DISABILITIES

Healthcare for people with learning disabilities: recommendations of the Parliamentary and Health Service Ombudsman (27th January 2010)
The Parliamentary and Health Services Ombudsman's report, 'Six Lives', highlighted failings in health and social care services that led to premature and avoidable deaths of people with learning disabilities. These letters from David Behan and Anne Williams to SHA chief executives and Directors of Adult Social Services respectively set out the action needed to respond to the recommendations set out in the 'Six Lives' report. Directors of Adult Social Services are reminded of the need to work in partnership with NHS colleagues when reviewing and reporting progress on implementation of the Ombudsmen's recommendations. SHAs are asked to report on progress by March 2010.

The Department of Health have today issued a letter from the National Director for Learning Disabilities to Directors of Adult and Children's social Services and Chief Executives of Local Authorities, Trusts and SHAs. This is an update on the Valuing Employment Now resource pack and a reminder of the business case for investment in supported employment. Employment will remain a top priority.

Use of medication in care homes (7th January 2010)
Recently published research commissioned by the DH as part of the patient safety programme identified considerable scope for improvement of prescription, dispensing, administration and monitoring of medicines in care homes. The study's authors recommend clear local leadership and improved inter-professional communication.

Transfer of commissioning and funding of social care for adults with learning disabilities from the NHS to local Government: final returns for 2009/10 by 15 January 2010 (17th December 2009)
From April 2009, funding and commissioning of social care for adults with learning disabilities transferred from the NHS to local authorities. The Department of Health have produced two letters, one for commissioners in primary care trusts and local authorities and one for strategic health authorities and deputy regional directors of social care, which gives further guidance.

Guidance to provide NHS bodies with a framework in which to use the power of removal in dealing with nuisance or disturbance behaviour on NHS premises in England through the use of powers contained in the Criminal Justice and Immigration Act 2008.

Interventional radiology: improving quality and outcomes for patients. A report from the National Imaging Board (25th November 2009)
The National Imaging programme is lead by Dr Erika Denton, National Clinical Lead for Diagnostic Imaging and chair of the National Imaging Board.

A sub-group of the National Imaging Board, has produced this report to inform and stimulate discussion about how Interventional Radiology (IR) Services can support the quality and productivity agenda. The document has been produced by interventional radiologists, nurses, radiographers, a patient representative and members of the Department of Health and National Imaging Board.

The report illustrates how the NHS can improve quality, safety and productivity while delivering comparable or better outcomes for patients with shorter hospital stays and fewer major complications. It suggests and describes how IR services can help to ensure patient safety whilst delivering the highest quality care.'

Windmill 2009. NHS response to the financial storm (3rd December 2009)
It is clear that the era of unprecedented investment in health care is over, and prospects for future funding now look bleak. But just how the NHS will respond to this is uncertain. To test how those in the system might respond, KingsFund used a behavioural simulation – Windmill 2009, designed by Loop2. From this event, and discussions with policy-makers, regulators, commissioners and providers, managers and clinicians, they developed an analysis of what will be required if health and social care systems are to respond effectively to the major challenges that lie ahead. They identify key themes and recommendations for action in each of these.

SHA process for PCTs to be listed in the Electronic Prescription Service (EPS) Authorisation Directions 2008 as amended (2nd December 2009)
This letter and supporting documents have been issued to set out the process that all SHAs will need to follow to request Secretary of State directions, to enable PCTs to authorise their primary medical services contractors or any practice established by the PCT to use Release 2 of the Electronic Transmission of Prescriptions (ETP) service.

DIRECTIONS

Directions about reports on consultation with regard to commissioning decisions and relevant decisions 2009 (13th November 2009)
These Directions are issued under sections 17A and 24A, and section 8, of the NHS Act 2006, and trigger the duty on primary care trusts and strategic health authorities to produce reports each year on consultation in relation to commissioning decisions, with effect from April 2010. The first reports will cover the period April 2009 to March 2010 and will be produced before the end of September 2010.

Real accountability: guidance on the NHS duty to report on consultation (13th November 2009)
New legislation will come into force in April 2010. The NHS duty to report on consultations will require all PCTs and SHAs that commission services to explain how they have acted upon feedback from patients and the public. ‘Real Accountability’ aims to help the NHS get ready for the legislation. The guidance explains the legal obligations and provides practical help and advice in terms of preparing and publishing reports.

Swine flu: guidance for planners (22nd October 2009)
The Department of Health and the Cabinet Office have today published new guidance to support pandemic planners based on the latest science and understanding of the swine flu virus. The latest evidence indicates that the pandemic may peak at a lower rate than we originally thought, but does not suggest that their should be any change to our response in terms of ensuring the NHS and social care organisations are as prepared and resilient as possible for the winter months.

Stock Management System training manuals (27th October 2009)
The Stock Management System (SMS) provides the DH and the NHS Users with an effective tool to manage the distribution of antivirals to PCTs and collection points in the event of a pandemic. It will provide stock level information, reports and the ability to record issuance from GP prescribed antiviral information, along with the management of full issuance from the collection point via the NPFS system.

This consultation is seeking views on the revision of the Department of Health's guidance on the ordinary residence provisions in the National Assistance Act 1948. It is also seeking views on draft Directions that set out local authority responsibilities when ordinary residence disputes arise and draft cross-border arrangements for dealing with ordinary residence disputes between English and Welsh authorities. Medical profiling and online medicine: the ethics of 'personalised' health care in a consumer age (April 2009)
The Nuffield Council on Bioethics is holding a public consultation on the ethical issues raised by online healthcare, telemedicine and commercial medical profiling technologies such as DNA testing and body imaging. These technologies and services are increasingly focused on the individual, and often mean that the GP is no longer involved in health care.

The Council would like to hear the views of a wide range of people, including those using or contemplating using these services, those involved in providing them in the public and private context, researchers, academics, regulators, policy makers and others. Closing date for responses is 21st July 2009.

A Department of Health consultation paper: draft guidance on provisions to deal with nuisance or disturbance behaviour on NHS premises in England (12th May 2009)
The Criminal Justice and Immigration Act 2008 creates a criminal offence of causing a nuisance or disturbance on NHS premises and a power for fully trained NHS to remove a person reasonably suspected of committing this offence.

This consultation seeks comment on a draft of the guidance which will be issued to support use of the power of removal by NHS bodies in England. Closing date for comments is 4th August 2009.

The Department of Health is investing £10 million in the introduction of Health Innovation and Education Clusters (HIECs) across England. HIECs will be partnerships between NHS, higher education, industry and other public and private sector organisations. They will support the spread and adoption of innovation locally and strengthen professional education and training.
