The Health Care Workers (Duty of Co-operation) Regulations 2010 (5th March 2010)
The Department of Healthare consulting on draft regulations which will impose duties on designated bodies, including employers and contractors of health care workers, in all sectors, and regulatory bodies, relating to sharing information about the conduct or performance of health care workers to protect patient safety. The regulations require appropriate safeguards in place when relevant information is shared.

Consultation on the de-authorisation of NHS Foundation Trusts (3rd March 2010)
Section 15 of the Health Act 2009 introduces new sections to the National Health Service Act 2006 concerning the de-authorisation of NHS foundation trusts.

Under the revised Act, either:
  • Monitor can consider de-authorising an NHS foundation trust which is seriously failing to comply with its terms of authorisation or any requirement(s) imposed on it under any enactment; or
  • the Secretary of State for Health may write to Monitor requesting that Monitor consider the de-authorisation of an NHS foundation trust.
In both cases, the de-authorisation decision must be based on guidance published by Monitor, and the revised Act requires Monitor to consult on this guidance before publishing.

This consultation document sets out Monitor's proposed approach and guidance on the criteria for de-authorisation.

Review of access to the NHS by foreign nationals (26th February 2010)
This consultation provides the public and others with the opportunity to comment on proposed changes to the charging Regulations for overseas visitors requiring hospital treatment and the recovery of any charges, and also initial thinking around possible future introduction of health insurance for some visitors. This may also be of interest to UK nationals/residents.

Consultation on a Strategy for Services for Chronic Obstructive Pulmonary Disease (COPD) in England (23rd February 2010)
Since 2005 the Department of Health (DH), the NHS, patients, clinicians and other key stakeholders have been working together to identify the best ways to improve care and outcomes for those with COPD and to reduce the overall prevalence of the disease.

The DH aim to produce a strategy that will:

  • ensure that everyone diagnosed with COPD receives equitable, responsive, high quality and effective provision of health and social care services from the right person, at the right time, in the right place, that are cost effective and provide good value for money for taxpayers.
  • advise how local communities can prevent people getting COPD, understand the risks of having poor lung health, secure improvements to the diagnosis and care of people with the disease, and reduce health inequalities.
  • support people with COPD and their carers by offering practical advice and education on managing their disease.

Teenage Pregnancy Strategy: Beyond 2010 (25th February 2010)
The Teenage Pregnancy Strategy: Beyond 2010 document sets out how the Department for Children, Schools and Families (DCSF) want to build on the existing Teenage Pregnancy Strategy to strengthen its delivery in all local areas and make further progress towards halving the under 18 conception rate and improving outcomes for teenage parents and their children. The Strategy aims to give young people the knowledge and skills they need to delay early sex until they are ready, to ensure they are able and confident to access and use effective contraception when they do become sexually active, and to provide effective support for teenage parents. Success depends on the contribution from a range of agencies. The DCSF welcome your views to help inform the next phase of the Strategy.

Adult Social Care. A consultation paper (24th February 2010)
This consultation, published by the Law Commission, contains their detailed proposals for law reform.

Provisional proposals include:
  • establishing a core set of overarching principles to guide social care decisions;
  • introducing a single and explicit duty to assess individuals’ needs;
  • a duty on local authorities to provide community services for all those eligible;
  • the introduction of a single duty to assess the needs of any carer;
  • a statutory duty on local authorities to investigate when they suspect that vulnerable adults are being abused or neglected.

Revalidation: the way ahead (1st March 2010)
The General Medical Council (GMC) has launched a major consultation on proposals for a new process of medical regulation to assure patients, employers and other healthcare practitioners that licensed doctors are up to date and fit to practise. The process is called revalidation. In future, all licensed doctors will need to revalidate on a regular basis if they wish to keep their licence to practise.

Your choice of GP practice: a consultation on how to enable to register with the GP practice of their choice (4th March 2010)
This consultation is seeking views from the public, from healthcare professionals and from other staff working in the NHS on new proposals that give patients a much greater choice of GP practice.

The consultation sets out the different options for organising healthcare for patients, and the potential implications of their choices if the current system of GP practice boundaries is removed.

It has been developed following a period of initial engagement with NHS colleagues, GPs, practice managers, and professional and patient groups.

Consultation on proposed tobacco control regulations for England (under the Health Act 2009): Summary of consultation responses (26th February 2010)
On 26 February the Department of Health (DH) published "Consultation on proposed tobacco control regulations for England (under the Health Act 2009): Summary of consultation responses" the Government’s response to the consultation that was carried out between 12 October 2009 and 4 January 2010 on four sets of proposed tobacco control regulations:
  • displays of tobacco products
  • regulating tobacco product prices lists and labels
  • specialist tobacconists
  • prohibiting tobacco sales from vending machines
This report is a summary of the 544 consultation responses received from a wide range of stakeholders, the views they expressed and the DH responses to the points raised.

Consultation on options for improving information on the labels of alcoholic drinks to support consumers to make healthier choices in the UK (15th February 2010)
The Government is launching a UK wide consultation on 15 February 2009 to consider how best to improve unit and health information for consumers on alcohol labels, whether through a renewed and strengthened voluntary agreement or a mandatory requirement through legislation under the Food Safety Act. The consultation is being launched jointly by the Department of Health, the Scottish Government, the Welsh Assembly Government, and the Northern Ireland Department of Health, Social Services and Public Safety.

Consultation report on the Human Fertilisation and Embryology (Parental Orders) Regulations 2010 (28th January 2010)
The Human Fertilisation and Embryology (Parental Orders) Regulations 2010 were published in draft for public consultation between 1 September 2009 and 23 November 2009. This report summarises responses received to the consultation.

Subject to Parliamentary approval it is anticipated these Regulations will come into force on 6 April 2010.

Reforming the Medical Statement. Government response to the consultation on draft regulations: The Social Security (Medical Evidence) and the Statutory Sick Pay (Medical Evidence) (Amendment) (29th January 2010)
Between 28 May 2009 and 31 August 2009 the Government undertook a consultation on draft regulations that will support the revised medical statement. The aim is for the revised medical statement to allow a doctor to consider not only whether their patient is unfit for work, but also whether their patient may be able to do work based on the doctor’s assessment of the patient’s health condition; it also simplifies the suite of medical statements.

The Social Security (Medical Evidence) and the Statutory Sick Pay (Medical Evidence) (Amendment) Regulations 2010 come into effect on 6 April 2010.

This document describes the comments made by respondents and provides the Government’s response.

The Department of Health began a 12 Week consultation on 29 January 2010 concerning the charging arrangements for residential social care. Views are sought on proposed amendments to the residential charging arrangements suggested by a stakeholder group. The consultation will close on 23 April 2010.

Sex and Relationships Education Guidance (25th January 2010)
The purpose of this consultation is to gather views on the draft document, Sex and Relationships Education Guidance. This document provides guidance to maintained primary, secondary, special schools and pupil referral units (PRUs) in England on all matters relating to SRE, including how good quality SRE can be planned and delivered, how to develop an SRE policy and how to support the health and social needs of all pupils with regard to sex and relationships. It is relevant to all staff, particularly senior managers and those responsible for co-ordinating, teaching and supporting the delivery of SRE. Headteachers and governing bodies are required by law to have regard to the guidance.

This Green Paper sets out a wide range of measures to support all families as they bring up their children and to help families cope with times of stress and difficulty. The consultation on the future strategy for adults with autustic spectrum conditions (ASC) closed on 15 September 2009. Over 1,100 responses were received, including from people with ASC, families and carers, voluntary sector organisations and health and social care bodies. This document is a summary of the findings from the consultation, setting out the approach taken, and the key themes and priority actions identified by respondents.

Adult autism strategy consultation. A summary of the submissions received in response to the online consultation (19th January 2010)
The consultation on the future strategy for adults with autistic spectrum conditions (ASC) closed on 15 September 2009. Health protection regulations: response to the consultation (13th January 2010)
This is the response to a Department of Health consultation which sought comments on proposals for three sets of regulations to be made under the amended Public Health (Control of Disease) Act 1984, taking forward the modernisation of health protection law. The regulations cover notification of hazards, safeguards for individuals and updated local authority powers. The consultation began on 8 July and closed on 30 September 2009. Subject to Parliament, it is planned that the regulations will come into force on 6 April 2010 (except certain provisions in the Notification Regulations which are planned to come into force on 1 October 2010).

Mainstreaming the commissioning of local services to address violence against women and girls (22nd December 2009)
Following the publication of the cross-government strategy "Together we can end violence against women and girls" on 25 November 2009, the Home Office have produced draft commissioning guidance to support local commissioners and partnerships. It will help them develop the best approach to commissioning services to prevent violence against women and girls, protect victims and potential victims and provide services to victims and perpetrators in local areas.

Responding to Lord Laming's recommendations for further guidance on effective practice for Local Safeguarding Children Boards - A Summary Outline for consultation and a call for evidence (December 2009)
In "The Protection of Children in England: A Progress Report" published by Lord Laming on 12th March 2009, he recommended that the Department for Children, Schools and Families must provide further guidance to Local Safeguarding Boards on how to operate as effectively as possible.

This summary outline builds on the progress already made in addressing Lord Laming's recommendations. The National Safeguarding Delivery Unit welcomes views on the proposed outline and issues that the practice guidance should cover.

Working Together to Safeguard Children (18th December 2009)
In "The Protection of Children in England: A Progress Report" Lord Laming made a number of recommendations which the Government has proposed to address through the revision of Working Together to Safeguard Children statutory guidance. This revised draft guidance addresses 17 of Lord Laming's recommendations, as indicated in the National Safeguarding Delivery Unit's earlier pre-consultation. The revised draft also updates the guidance to reflect changes to the policy and legislative landscape since Working Together was last published in 2006.

Pharmacy in England: building on strengths - delivering the future - Draft regulations under the Health Act 2009: pharmaceutical needs assessments. Consultation document (1st December 2009)
Following consultation in Autumn 2008, two clauses were introduced in the Health Bill 2009 (now the Health Act 2009).
  • to require Primary Care Trusts to develop and publish pharmaceutical needs assessments (PNAs); and
  • then to use PNAs as the basis for determining market entry to NHS pharmaceutical services provision
In July 2009, a regulatory Advisory Group drawn from interested parties was set up, chaired by Paul Burns. The first set of draft regulations regarding PNAs have now been prepared by the Department of Health with assistance from the Group and are available for consultation.

A Consultation on proposals for the Innovation Pass pilot (28th November 2009)
In July the Office for Life Sciences (OLS) published the ‘Life Sciences Blueprint’ which announced a package of measures to help maintain a competitive life science sector. One of the initiatives announced in the blueprint was the introduction of an ‘Innovation Pass’.

This consultation seeks views from the NHS, industry and other stakeholders on the Government’s proposals for an Innovation Pass pilot. These proposals will be revised in light of comments received as part of this consultation and will be used to inform the first set of decisions for the pilot in 2010/1

Personal care at home: a consultation on proposals for regulations and guidance (25th November 2009)
A consultation document containing proposals for regulations and guidance made under the Personal Care At Home Bill has been published today. An impact assessment accompanying the consultation is also available. An easy read version will be available soon.

Although closing date for comments is 23rd February 2010, the Department of Health would like, if possible, comments to reach them by 26th January 2010.

Provision of calorie labelling at point of choice in catering outlets (3rd December 2009)
The Food Standards Agency is seeking views on how a voluntary scheme to display calorie information on menus would work best in practice.

A calorie labelling scheme would help people make healthier choices when they are eating out, by letting them see the number of calories in the food and drink they order – whether they are in restaurants, coffee and sandwich shops, pubs, leisure attractions or staff restaurants.

Age equality in health and social care: a consultation on preparing the NHS and social care in England for the age requirements in the Equality Bill that affect the provision of services and exercise of public functions (23rd November 2009)
In April 2009, the then Secretary of State for Health asked Sir Ian Carruthers OBE, Chief Executive of NHS South West, and Jan Ormondroyd, Chief Executive of Bristol City Council, to undertake a review of age discrimination and age equality in the health and social care sector.The review was set up to help health and social care meet the ban on age discrimination and the new public sector equality duty in the Equality Bill.

The review published its report to the Secretary of State, Achieving age equality in health and social care, on 22 October 2009 and the consultation paper now invites views on the recommendations and conclusions made that are not directly tied to the legislation.

NHS Constitution: a consultation on new patient rights (10th November 2009)
The NHS Constitution brought together in one place what the NHS does, what it stands for and the commitments it should live up to. It describes and renews our commitment to the values and enduring principles of the NHS. It is also a living document that needs to reflect what matters and is relevant to the needs of patients, the public and staff in the 21st century.

This consultation proposes new patient rights to:
  • treatment within a maximum of 18 weeks from a GP referral and to be seen by a cancer specialist within 2 weeks from a GP referral, or where this is not possible, for the NHS to take reasonable steps to offer a range of alternative providers; and
  • NHS Health Checks for those aged 40 to 74 to assess their risk of heart disease, stroke, diabetes and kidney disease

Regulatory fees - have your say. Fees for National Health Service providers that are registered under the Health and Social Care Act 2008 from April 2010 (2nd November 2009)
From April 2010, NHS providers must pay fees for their registration with Care Quality Commission (CQC) under the Health and Social Care Act 2008. This consultation document sets out the (CQC) proposals for an interim scheme of fees for NHS providers, while the registration system is being phased in during 2010-2011.

The Human Fertilisation & Embryology Act 1990: disclosure of identifying information for research: regulations for consultation (8th October 2009)
The regulations establish a procedure for authorising the disclosure of identifying information held by the Human Fertilisation and Embryology Authority, for research purposes, where it is not practicable to obtain consent to the disclosure from the persons to whom the information relates.

This is the second consultation exercise. Closing date for comments is 2nd December 2009.

Implementing the Health Act 2006: review of fees for applications to provide pharmaceutical services in England: consultation document (12th October 2009)
The National Health Services Pharmaceutical Services (Fees for Applications) Directions 2008 (as amended in April 2008) came into force on 21 April 2008 and specify the types of application for which a fee will be payable and the levels of such fees. The Government undertook during the passage of the Health Bill 2006 to consider a general review of this measure 18 months after it was introduced.

The Department of Health would welcome comments and views on the impact of charging on the NHS, pharmacy and appliance contractors and applicants and whether or not the current fees represent a fair contribution to NHS costs.

Consultation on proposed tobacco control regulations in England (under the Health Bill 2009) (7th October 2009)
Protecting children from the health harms of smoking is a public health priority for the Government. The Health Bill 2009, currently before Parliament, includes proposals on two areas to safeguard children - provisions to prohibit the display of tobacco products and regulation-making powers to limit access to tobacco vending machines.

This consultation aims to inform parliamentary debate and gives an important opportunity for stakeholders to consider the practical implications of the details that are set out in the proposed regulations. Views are also invited on the two Partial Impact Assessments, which accompany the proposed regulations.

Consultation on the proposed framework for Quality Accounts (17th September 2009)
The Department of Health has launched a public consultation on the proposed framework for Quality Accounts. Quality Accounts will be legally required of all providers of NHS Healthcare from June 2010 (subject to the successful passage of the Health Bill). For the acute sector, the duty applies next year and it will apply to primary care and community services subsequently.

Supporting our future NHS workforce: a consultation on the NHS Bursary Scheme (15th September 2009)
This consultation is seeking the views of staff, patients, students and other stakeholders on the future of financial support for NHS-funded students. We are consulting on a number of options that we believe will enhance the existing way in which we support prospective NHS staff through their educational pathway.

Pandemic influenza and the Mental Health Act 1983: consultation on proposed changes to the Mental Health Act 1983 and its associated secondary legislation (10th September 2009)
The Department of Health are inviting comments on proposals for temporary amendments to the Mental Health Act 1983 which may be required in the event of the severe staff shortages that may be expected during an influenza pandemic.
